General Terms and Conditions (GTC) – Olymam

1. Provider and Contracting Party

1.1 Scope

These GTC apply to all contracts between Olymaris and users of the digital pregnancy support application “olymam” (hereinafter the “App” or the “Service”).

2. Description of Services – Purpose

In accordance with the MDCG 2021-24 guidelines, “olymam” is not software with a medical purpose within the meaning of Regulation (EU) 2017/745. The app/website “olymam” is a non-medical, digital information and organization offering for pregnant women, mothers and family members. It serves solely the general provision of knowledge, everyday organization and the promotion of personal well-being with the following content:

• Childbirth preparation and pregnancy
• Basics of care for newborns and postpartum women
• These observations serve solely general awareness and are made without evaluation of individual health data.
• First aid measures for infants and toddlers (generally accepted emergency rules)
• Appointment calendar with reminder function

Explicit Disclaimer of Liability

All notices serve solely to raise users’ awareness and do not replace diagnosis, monitoring, prediction, prognosis, examination, advice or treatment by physicians, midwives or other healthcare professionals. In case of health-related questions or irregularities, it is always recommended to seek professional medical advice without delay.

3. Language

We strive to use gender-inclusive language. Technical terms are used in their legally or biologically usual context without discriminatory intent.

4. Liability

The provider’s liability is limited to intent and gross negligence, except for:

• Damage to life, body, health
• Breach of essential contractual obligations
• liability under the Product Liability Act

Limited liability: In cases of slight negligence, liability exists only for breaches of essential contractual obligations (cardinal duties) and is limited to foreseeable, typical damage. This limitation of liability also applies in favor of our legal representatives and vicarious agents.

5. Term and Termination

• The contract begins upon conclusion. Minimum term: 30 days or 12 months (depending on selection at contract conclusion).
• Automatic renewal by 1 month each time unless terminated in due time.
• Notice period: 1 month to the end of the contract month. Receipt of the notice by the provider is decisive.
• Termination in text form (e.g., email or via customer account).
• The right to extraordinary termination remains unaffected.

6. Conclusion of Contract and User Account

6.1 Conclusion of contract

The contract is concluded when you expressly agree to the GTC during the registration process and complete registration.

6.2 User account

You undertake to provide truthful information, to keep your login credentials confidential, and to inform us immediately if misuse is suspected.

7. Subscriptions, Prices and Right of Withdrawal

7.1 Models

• Basic Plan: free, 10 messages/day
• Premium Plan: €9.99/month incl. VAT

7.2 Right of withdrawal for consumers

As a consumer, you have the right to withdraw from this contract within 14 days without giving reasons. Details can be found in our withdrawal policy.

7.3 Payment

Payment is made monthly in advance via the payment methods specified in the app.

8. User Obligations

Permitted use

• Use for private purposes only
• Truthful information

Prohibited activities

• Transmission of unlawful, insulting or discriminatory content
• Web scraping or automated data extraction
• Circumvention of security functions
• Commercial use without express permission

In the event of a breach, the provider reserves the right to temporarily suspend the user account or to terminate without notice. Any statutory claims for damages remain unaffected.

9. Changes to the GTC

We will inform you of changes to our GTC at least 6 weeks before their planned entry into force. Your express consent is required for the changes to become effective. Without consent, the previous GTC remain in force.

10. Availability

We strive for high availability, but cannot guarantee 100% uptime. Maintenance is carried out where possible outside peak usage times.

11. Intellectual Property

All content is protected by copyright. Any use beyond the contractual scope is not permitted.

12. Data Protection

Our privacy policy applies: https://olymam.com/datenschutz. It forms part of the contract.

12. Dispute Resolution

We do not participate in consumer dispute resolution proceedings. EU platform: https://ec.europa.eu/consumers/odr/

13. Final Provisions

German law applies with the exclusion of the UN Convention on Contracts for the International Sale of Goods. Should any clause be invalid, the statutory provisions apply. The contract language is German.
